About The Dissolution Solution

What is an uncontested divorce?

An uncontested divorce matter occurs when both spouses agree on all key issues such as property division, spousal support, child custody, and timesharing—allowing the divorce to proceed without litigation. This leaves the decision making to the parties, and not to a state judge that has never met either of the parties before.

Choosing an uncontested path can dramatically reduce the emotional strain and financial cost of ending a marriage. Consider these statistics:

  • The average cost of a contested divorce in the U.S. is $15,000 to $20,000 per person, depending on the complexity of the case and whether custody is involved.
  • In Florida, costs can reach or exceed $25,000 per spouse in litigated cases.
  • A contested divorce case can take 12–18 months or longer to resolve, often depending on court backlogs.
  • In contrast, an uncontested divorce can often be finalized in as little as 30 to 60 days, depending on the county.

At The Dissolution Solution, we focus on collaborative resolutions—helping clients preserve both peace of mind and their bank accounts.

Legal Services of The Dissolution Solution

Uncontested Dissolution Cases

Uncontested Dissolution Cases

At The Dissolution Solution, we streamline the uncontested divorce process for you. Here’s how it typically works:

  1. Petition for Dissolution of Marriage
One spouse files the initial petition with the court. We will typically represent the petitioner, filing a notice of appearance on their behalf. We cannot represent both sides in a court case, so one of the parties will be represented by another lawyer, or be “pro-se” meaning that the party represents themself.
  2. Answer & Waiver
The other spouse signs an answer and waiver, acknowledging receipt of the petition and agreeing to proceed without formal service.
  3. Financial Affidavits
Each spouse completes and exchanges a financial affidavit disclosing assets, income, and debts.
  4. Marital Settlement Agreement     The terms of the divorce (e.g., property division, alimony, parenting plan) are put into a written agreement signed by both parties.
  5. Final Hearing
A short, non-adversarial hearing is held before a judge, who enters the Final Judgment of Dissolution of Marriage—making the divorce official.

Our firm manages and expedites the entire process from start to finish, guiding you with professional legal support and prompt communication.

Prenuptial Agreements

The Dissolution Solution also represents clients in the drafting and execution of prenuptial (ante-nuptial) and postnuptial agreements.

  • A prenuptial agreement is a legally binding contract entered into before marriage that outlines how assets, debts, and other matters will be handled in the event of divorce or death.
  • A postnuptial agreement is similar, but is created after the couple is already married.

These agreements can provide clarity, reduce conflict, and protect the rights and expectations of both spouses. We work with individuals to craft agreements that are thorough, enforceable, and tailored to their unique financial and personal circumstances.
